GENERAL SALES TERMS AND CONDITIONS

Please read this document carefully.

These conditions have been in force for all Customers since October 1, 2021.

We try to keep our general terms and conditions of contracting and use as clear as possible and provide you with all the necessary information about online transactions in our store so that you can easily understand the entire process, from ordering, delivery to a possible refund if applicable.

It is very important to us that your online shopping experience meets your expectations, so we appreciate you taking a few minutes and continuing reading. The website www.vaibuscar.pt is owned by BRDEV Consulting unipessoal lda, with headquarters at Av. Do Atlântico, 16, 14º esc 8, Parque das Nações, 1990-019, Lisbon, registered at the Commercial Registry Office of Lisbon under number single registration number and legal entity 514 594 810, with share capital of €300.00.

2. Object and scope of application
These general terms and conditions of contracting and use apply to visitors to the website www.vaibuscar.pt and to any commercial transactions carried out through the online store.
Browsing the website, as well as purchasing any product in the online store at www.vaibuscar.pt, implies acceptance of these General Conditions of Contract and Use by the User and the Customer.
We reserve the right to refuse service to anyone, for any reason, at any time.

3. Intellectual property
All texts, illustrations, comments, works, works and images reproduced or published on the website www.vaibuscar.pt are protected by respective copyright, worldwide. Therefore, under the terms of the Copyright and Related Rights Code, only its use for private purposes will be authorized, without prejudice to more restrictive provisions contained in the aforementioned Code. Any total or partial reproduction or representation of the website www.vaibuscar.pt or all or part of the elements included therein is strictly prohibited, under penalty of recourse to competent legal means against anyone acting in this way.

Corporate names, brands, as well as any distinctive signs reproduced on the website www.vaibuscar.pt are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of these distinctive signs is strictly prohibited and must be subject to prior written authorization from the respective owners. Certain Products, such as computer programs (software), are subject to personal and specific rights of use that regulate their copies, public dissemination and rental. The Customer must comply with the general conditions of sale of these Products, and VaiBuscar will not be held responsible for any misuse made of them.

If, at our request, you send certain specific submissions (for example, contest entries) or without a request from us you may send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and take no responsibility for any comments posted by you or any third-party.

4. Security conditions
VaiBuscar values ​​itself in respecting the personal data of all users of its website and is committed to protecting all personal information that each user decides to place there.

There may be areas of the website that can be accessed without the user providing any personal information. However, when the collection of data becomes necessary for the supply/availability of products/services, or if the user decides to provide their personal data, the collection and use of these will comply with the criteria of the legislation applicable to the protection of personal data - Regulation General Data Protection – so that the confidentiality and security of the personal data provided is ensured.

VaiBuscar reserves the right, without the need for prior notice, to change and update security procedures, always in full respect of the rights of data subjects and guided by the principle of responsibility set out in the GDPR. Despite the security procedures mentioned above, there are risks when using the Internet, over which VaiBuscar has no control and which require permanent attention and care from data subjects.

5. Data processing
VaiBuscar is the entity responsible for collecting and processing personal data. Personal data provided by users will be subject to automated processing and will appear in VaiBuscar's database(s).

VaiBuscar, as controller, as well as its subcontractors will have access to personal data, the latter only in that capacity and within the duly contracted limits. Subcontractors will only have access to personal data strictly necessary to achieve the intended purposes.

The personal data provided to VaiBuscar will be used exclusively for customer management, including profiling, and for marketing and advertising purposes. Data processing operations have the following legal bases:

  • Execution of a contract: sale of products, repair services and delivery services; or
  • Consent of the data subject: customer file, definition of profiles and transmission of data to third parties; or
  • Legal obligation: invoicing.

If data processing is based on the consent of the data subject, he or she may, at any time, withdraw the consent already given, without such withdrawal having repercussions on the legality of the processing carried out until then.

The Data Holder may, at any time, request the Data Protection Officer to exercise legally provided rights, even under the terms of the GDPR and other applicable personal data protection legislation, namely:

  • right of access;
  • right to rectification;
  • right to erasure;
  • right to limitation of treatment;
  • right to object to treatment;
  • right to data portability;
  • right to lodge a complaint with the CNPD.

6. Obligations of Customers and Users
The Customer and the User undertake to comply with and respect these General Conditions of Contract and Use, namely:
Refrain from introducing, storing or disseminating through the website defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order;
Saving, and not disclosing, your password to enter the website in order to prevent third parties from accessing your account at www.vaibuscar.pt;
Do not use false identities;
Providing personal data and correct addresses so that VaiBuscar can properly process orders.

Its users are therefore expressly prohibited from transmitting messages or information that are offensive, misleading, defamatory, obscene or that violate, in any way, the right to privacy or intellectual or industrial property of third parties, as well as the provision of any information that may be harmful to third parties or the website owner.
VaiBuscar reserves the right to delete the account of the user who fails to comply with any of the aforementioned Obligations.
The Customer is responsible for the veracity of the data communicated to VaiBuscar and undertakes to immediately insert any changes to them into their VaiBuscar Registration Account on the website www.vaibuscar.pt.
VaiBuscar declines any responsibility for any delay or impossibility of processing the order, particularly at the time of delivery, resulting from an error or insufficient data communicated by the Customer.

7. Products and Prices
All prices are for sale to the public, in euros and include VAT at the legal rate in force, and are also exclusive to the online store.
All promotional campaigns have limited and exclusive stock for online marketing.
The “Low Price Guarantee” policy is not applicable to the website www.vaibuscar.pt, particularly in price comparisons with “physical” stores, their similar online stores, or other websites.
VaiBuscar reserves the right, at any time, to replace or modify the available products, their respective prices and the conditions presented, safeguarding orders already placed.
VaiBuscar only processes an order placed by a Customer after confirmation of the respective payment, therefore VaiBuscar cannot guarantee the availability of the items until the aforementioned processing begins. In addition to the estimated shipping time, transport time is added, which depends on the chosen carrier, as well as the destination of the order.
VaiBuscar only ships on business days. Therefore, neither weekends nor holidays are taken into account when estimating delivery of orders. Estimated delivery dates are indicative only.
If there is unavailability of any product ordered, and after having contacted the supplier to inquire about the possibility of replacing the missing item, VaiBuscar will contact the customer if the delivery time or the price of the item changes and the order will only proceed after consent given by the client for this purpose.
In case of absolute unavailability of stock of the ordered product, VaiBuscar may propose to the Customer the supply of a product of equivalent quality and price, if available, and, also in this case, the order will only proceed after consent given by the customer.
In the event of absolute unavailability of stock of the ordered product, and it is not possible to offer the Customer any product of equivalent quality and price or the Customer has not given their consent to change the order initially placed, VaiBuscar will reimburse the amounts paid by the Customer, within a maximum period of 30 (Thirty) days after notification of cancellation.
VaiBuscar makes every effort to ensure that the information presented is free from typographical errors (in the descriptions, characteristics, values ​​and/or images/photographs of the products) and whenever these occur and are detected, it will correct them immediately.
We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of products and/or the Service.

8. Orders
The user can place their order online, at www.vaibuscar.pt. Orders in the VaiBuscar online store can be placed 24 hours a day, 7 days a week.
While browsing the store, you can add to the shopping cart by clicking the “Add”, “Add to cart” or “buy now” button. When you have finished selecting the products, you can select the “Continue to order” option to make the purchase. In the “delivery location” field, you can inform delivery to an address you indicate.
VaiBuscar has no liability in case of violation of the legislation of the country where the order is delivered. It is the Customer's responsibility to check with local authorities the conditions for importing or using the Products they wish to order.
After entering your personal details, you will be asked to confirm them and also confirm your intention to place the order. Once confirmed, the order cannot be cancelled, except for the right of withdrawal under the terms of point 11 of these “General terms and conditions of contracting and use”. Your order will not be accepted and the contract will not be concluded until you receive, by email, confirmation of acceptance of the order by VaiBuscar. Once your order has been accepted, you will be notified of the reference number that will allow you to track the delivery of the products.
In the event of lack of availability of the product(s), VaiBuscar undertakes to inform the user and reimburse them for any amounts they may have paid within a maximum period of 30 (thirty) days from the date of knowledge of this unavailability.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per family or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

9. Order delivery
In the case of deliveries outside the EU or to the Canary Islands, Ceuta and Melilla, customs duties at the destination or other taxes (customs) are not included. If they are applied, the consignee will be responsible for paying them, as well as the expenses and import taxes generated at customs at the destination, whether or not the products are delivered, and whether or not the consignee accepts them. We will do our best to deliver orders in the shortest period of time, but you must take into account the regulations of the country of destination for the import of items, as VaiBuscar will not be responsible for them or for the effects caused by strikes, armed conflicts or other circumstances beyond its control. VaiBuscar will not be responsible for delays in customs clearance or if local authorities decide to confiscate any item contained in the order.
Delivery costs depend on the type of products and the type of delivery chosen.
Small orders (up to 20kg) will normally be delivered by courier (CTT Expresso) or currier (transport companies) between 8am and 7pm on weekdays, or by freight forwarders for large orders (more than 20kg) , in the morning between 8 am and 2 pm and in the afternoon between 2 pm and 8 pm, from Monday to Saturday.
For orders paid by Bank Transfer, Credit Card, ATM, MBnet, the shipping period will, in principle, be up to 24 hours on working days, from the date of receipt and confirmation of payment of the order by VaiBuscar, unless there is a breakage stock, in which an alternative shipping period will be proposed.
Delivery will be made upon signature of the receipt, by anyone who is at the indicated address and who is, from that moment on, responsible for delivery to the Customer. If no one is present at the address indicated, the order will remain at the CTT station in the area of ​​the address mentioned above for 3 working days, after which it will be returned to VaiBuscar, for orders where the shipping method is CTT Expresso. For the remainder, the articles will return to VaiBuscar. For orders returned to VaiBuscar, a new delivery will be scheduled, which will be paid for by the Customer.
Payment can be made at the time of order confirmation via Multibanco, MBNet, Credit Card - VISA/MasterCard (subject to confirmation) and Bank Transfer.

10. Payment methods
VaiBuscar in its online store has several payment options for your order:

Credit card (Visa and MasterCard) - The Customer will have to enter/enter all requested data. If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of VaiBuscar).

MBNet - The Customer will have to enter/enter all requested data. If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of VaiBuscar).

MBWay - You have 5 minutes after placing the order to proceed with payment. The Customer will have to enter the mobile phone number associated with MBWay and confirm the respective payment in the MBWay application. If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of VaiBuscar).

Multibanco - You have 24 hours after placing your order to make the payment at an ATM (Multibanco) or home banking, using the data provided in your order confirmation (entity/reference/amount) and sent to the email address of registration. This data is also saved in the customer account under “orders”. If payment is not made after the 2nd day, the order will be cancelled.

If the information about the transaction given by the payment platform is non-acceptance of payment, the order will be canceled and the Customer will be informed of this fact. (Payment cancellation is outside the control of VaiBuscar).

Promotional codes - Promotional codes obtained from the online store are only valid in the online store.

11. Warranty
See warranty policy page.

In accordance with the provisions of Decree-Law No. 67/2003, of April 8th, with changes introduced by Decree-Law No. 84/2008, of May 21st, all equipment sold at www.vaibuscar.pt is covered by a guarantee of conformity of the goods corresponding to a period of 2 (two) years, this period may be reduced to one year in the case of used movable goods, in accordance with applicable legislation.

If the purchased product is defective or damaged:
You can report this to vaibuscar.pt Customer Support, providing your order number and the description of the malfunction. The costs of returning or collecting items within the Guarantee period will be borne by VaiBuscar.
After receiving the item at VaiBuscar's facilities, we will carry out a technical check. If we prove any lack of conformity, the item will be delivered to the brand's technical assistance department for the lack of conformity to be repaired or replaced.
If the technical check detects signs of misuse, and/or any problem that may have caused the item to malfunction (e.g. falling, humidity, etc.) you will be contacted to tell us if you want us to repair the equipment by sending the even for the brand's technical assistance.

12. Damage during transportation
Small items (up to 20kg), normally delivered by courier (CTT Expresso) or courier (transport company):

Upon delivery, check the condition of the packaging.
If it presents any anomaly (damaged, wet, torn box,...), you must REFUSE the order (in this case, without opening it).
If you decide to accept the order, you must request the delivery sheet from the courier and place what you can visually verify on the packaging and also write "reservations at the time of delivery, subject to verification".

Large items (> 20Kg), normally delivered by freight forwarders:
ALWAYS ask for the item(s) to be unpacked.
Check whether the item(s) has any visible exterior and/or interior cosmetic damage. If so, DO NOT accept it(s).
Check that the item(s) has all parts or components. If not, DO NOT accept it(s).

If the item is not in perfect condition, you must refuse the item upon delivery.

If the item is not in perfect condition, you must refuse it at the time of collection.

13. Termination of the contract
The Customer has, under applicable law, the right to terminate the contract (without payment of compensation and without the need to indicate the reason), which must be exercised in writing, using the form on the contact page at www.vaibuscar.pt , or email, letter or telephone Customer Support within 14 days from the date of receipt of the order (article 10, no. 1 of DL 24/2014 of 14 February).
Items must be returned within 14 days after communication of the decision to terminate the contract and accompanied by the original invoice (article 13, no. 1 of DL 24/2014 of 14 February).
The transportation costs for returned items will be borne by the Customer, except when they cannot, due to their nature or size, be returned by post. (article 13, no. 2 of DL 24/2014 of 14 February) or if your return is justified by the existence of a defect or non-conformity with the products ordered. Under no circumstances should you send items without prior contact as they will not be received.

The return and exchange of items must comply with the following conditions:

  • Return of items and their accessories in good condition, with complete original packaging and accompanied by the respective invoices;
  • CDs, DVDs and Software in original sealed plastic packaging with the IGAC seal intact;
  • Household appliances for personal use (shavers, epilators, toothbrushes...), in original sealed packaging, unless non-conformity;
  • Food items (coffee, coffee pods, coffee capsules...), in original sealed packaging. (article 13, no. 3 of DL 24/2014 of 14 February), (article 14, no. 2 of DL 24/2014 of 14 February) and (article 17, no. 1 of DL 24/2014 of 14 February).
  • The products have not been washed or used (unless the product contains information to the contrary, the customer has the right to try on the clothes and shoes to test the size and shape, but cannot wear them);

VaiBuscar does not accept the return or exchange of these items once used.

After contacting vaibuscar.pt Customer Support and having been given return instructions, you can send us the item properly packaged, with original packaging, to the address that will be informed by customer support.

If you choose to refund the amount, we inform you:
Refunds are made using the same method in which the payment was made. In the case of payment by Multibanco or Bank Transfer, we ask that you provide us with an IBAN (international bank account number), so that we can make the refund more quickly.
The return will only be made after technical verification of the condition of the product, within a maximum period of 14 days from the date of receipt of the free resolution communication.
VaiBuscar reserves the right to not accept items that do not comply with these conditions.

14. Conflict Resolution
Under Regulation (EU) no. 524/2013 of the European Parliament and the Council, of May 21, 2013, you can use the ODR - RLL platform in Portuguese.

15. Validity of the promotion
Offers on the website are only valid for the moment they are displayed on the website, unless information to the contrary is communicated on the website. VaiBuscar is not linked to any offer if there are errors or mistakes in spelling, prices or other errors in the information on the website. VaiBuscar reserves the right to cancel any purchase and sale made based on such errors.

16. Responsibility
VaiBuscar will only be responsible for damages suffered by the customer in the event that such damages result from breaches attributable to VaiBuscar's contractual obligations to the customer, or in the event that VaiBuscar's liability arises from applicable legal law.

If the customer has suffered damages related to the website's activity, VaiBuscar's liability will be limited to:
Damage to VaiBuscar products or other materials;
Reasonable and demonstrable costs incurred by the customer to find the cause and amount of compensation attributable to the damage;
The maximum reimbursement of the aforementioned compensation will be (if applicable) the price of the products in question.

VaiBuscar cannot be held responsible for damages suffered by third parties resulting from the use of any of our products. VaiBuscar cannot be held responsible for damages suffered by the customer as a result of improper use of our products.
VaiBuscar is not responsible for damages resulting from incorrect information on the website.
In the event that the customer suffers damages that are the result of gross negligence or willful misconduct on the part of VaiBuscar, none of the limitations contained in this article will apply.

17. Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the third-party provider(s) ( s) relevant(s). We may also, in the future, offer new services and/or features through the Website (including, the release of new tools and resources).

Certain content, products and services available through our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. VaiBuscar has the right to change these Terms & Conditions at any time. The customer is subject to the principles and terms in force at the date of their order, unless the law or competent authority imposes any change to them.

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Service or any related website,
